The extraterritorial taxation of German registered IP has been on the radar of many multinational enterprises over the last two years. Though many MNEs are supposedly treaty protected, there are significant procedural and legal hurdles to overcome when claiming treaty relief for historic transactions as well as for future ones (in addition to practical problems arising from the large backlog in the processing of pending applications).
