About Sascha Schubert

Sascha helps his clients successfully navigate complex antitrust and regulatory proceedings, with a focus on European Commission matters. He is an expert in the telecoms and technology sector.

Sascha has extensive experience advising on platform regulation, including the EU’s Digital Markets Act (DMA), on which he has co-authored a legal commentary. For more than 15 years, he has successfully guided telecoms clients through a range of high-profile phase two merger control and antitrust investigations. His experience across other sectors spans pharma, energy, aviation, shipping as well as industrials and manufacturing.

He speaks German, English and French.

Recent work

  • Apple on the European Commission's investigations into its compliance with the Digital Markets Act (DMA).
  • Liberty Global on a number of complex merger control and antitrust proceedings, including several phase II and remedy cases such as the European Commission’s Phase II merger investigation of the €18bn sale of its German and Eastern European businesses to Vodafone or Telenet's acquisition of Belgium’s BASE. Most recently, Sascha advised on Telenet acting as a remedy taker to enable clearance of the merger between Orange and VOO in Belgium, and on the EU merger control clearance for Telenet’s fibre JV with Fluvius.
  • Siemens on various proposed acquisitions, including the Siemens/Alstom merger project which continues to be referred to as one of the most important test cases for the European merger control regime; as well as on defending Siemens successfully against several antitrust investigation by the European Commission.
  • Medical diagnostics company Alere on the multi-jurisdictional merger control aspects, which included litigation relating to co-operation covenants before the US courts, of its $5bn merger with Abbott, resulting in clearance subject to divestment remedies in the EU and the US.
  • CK Hutchison on its takeovers of Telefónica’s Irish mobile phone operator O2 and Orange Austria, both four-to-three mobile market consolidations that trigged Phase II investigations by the European Commission.
  • Amadeus IT Group on its acquisition of US airline IT company Navitaire, as well as on Amadeus' successful defence in the European Commission's multi-year antitrust investigation into parity clauses, resulting in closure of the case without finding of an infringement.

Education

  • Educated at the University of Cologne and at the University of Paris I (Panthéon-Sorbonne)
  • Earned an LL.M. and the Maîtrise en Droit respectively
